Terms of Use

These Terms are an agreement between you and Mustafa Batın Efe in Türkiye ("Uyqu," "we," "us," or "our"). By downloading, accessing, accepting the Terms in the app, or using Uyqu, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Uyqu.

Apple's Standard Licensed Application End User License Agreement also applies to the app and is incorporated into these Terms. These Terms add product-specific rules for Uyqu. Mandatory consumer protections and Apple's standard terms prevail where they cannot lawfully be changed.

You must be at least 18 years old and legally able to enter this agreement. Uyqu and its AI generation service are not offered to anyone under 18, even with parental or guardian consent. You may not use the service if doing so would violate applicable law.

Uyqu provides soundscape playback, wind-down tools, optional on-device sleep listening and insights, AI-generated soundscapes, local storage, export of eligible completed AI creations, and optional private iCloud soundscape sync. Features may depend on your device, iOS version, network connection, Apple services, region, subscription status, and third-party availability.

We may improve, add, remove, suspend, or discontinue features. We will not intentionally remove paid access contrary to applicable law, and we will give notice when required. Uyqu does not guarantee uninterrupted availability or that every AI generation will complete or match your preferences.

• Sleep scores, sound labels, trends, and suggestions are estimates for general wellness and may be incomplete or wrong.
• Do not rely on Uyqu for an emergency, diagnosis, treatment decision, or safety-critical monitoring.
• Seek a qualified healthcare professional for persistent sleep problems or health concerns. Contact local emergency services for an emergency.
• You decide when to activate the microphone. You are responsible for complying with recording and consent laws and respecting other people who may be audible.
• Do not use headphones, audio, breathing exercises, or the app in circumstances where reduced awareness could be unsafe, including while driving or operating machinery.

After legal consent, Uyqu creates a disposable Firebase installation session to secure generation and delivery. Apple's signed App Transaction lets Uyqu's backend derive an opaque private account identifier for entitlements, credits, quota, and support. There is no login wall, and Uyqu does not request your Apple name or email.

The private account returns automatically after an ordinary app deletion or on another device using the same App Store account. A separate Support ID lets support locate the opaque account but is not a password or proof of ownership. Using the in-app Delete account control is different: it permanently erases the Uyqu account and remaining purchased-credit balance. Do not share, transfer, sell, or attempt to create multiple identities to evade limits.

• Uyqu may offer weekly and annual auto-renewable Pro subscriptions. The exact duration, local price, included features, and any offer terms appear in the App Store purchase sheet before confirmation.
• Payment is charged to your Apple Account when Apple confirms the purchase. Taxes and currency conversion may vary by region.
• Your subscription renews automatically for the displayed period unless you cancel at least 24 hours before the current period ends. Apple may charge the renewal within 24 hours before the end of the period.
• You can view, manage, or cancel through your Apple Account's subscription settings. Cancellation normally takes effect at the end of the already-paid period.
• Deleting Uyqu does not cancel a subscription.

You can open Apple subscription settings or use Manage subscription in Uyqu Settings.

• An active, paid Pro subscription currently includes up to 7 AI soundscape generations in a rolling 7-day window. This is not a calendar-week reset: each used allowance becomes available again seven days after that generation was charged.
• Uyqu uses the included rolling allowance first. When it is exhausted, an active paid Pro subscriber may use separately purchased AI generation credits.
• Credit packs are one-time consumable in-app purchases. Each credit permits one accepted generation request. Purchased credits do not expire, but they have no cash value, are not transferable, and require active paid Pro access to use.
• The server ledger—not a counter displayed on a device—is authoritative for subscription status, rolling usage, credit balances, grants, and refunds.
• A quota slot or credit is reserved when the backend accepts a generation. It is automatically returned only for an eligible backend failure before a ready result is committed. Once a valid ready result is committed, the generation remains used even if you do not finish downloading it, delete it, do not enable iCloud, or dislike the creative result. Interrupted secure delivery can normally resume without a second charge.
• A refund, chargeback, purchase reversal, or configuration error may reverse the related grant. A reversed balance can become negative; later grants first repay that balance before becoming spendable.

Limits or pack sizes may change prospectively for future subscription periods or purchases. We will show current material terms before purchase and will not retroactively expire valid purchased credits.

Apple processes all payments, cancellations, refunds, taxes, and payment credentials. Uyqu cannot directly refund an App Store transaction. Requests are subject to Apple's policies and applicable consumer law. Nothing in these Terms limits a refund or remedy that the law requires.

Restore purchases can recover eligible subscription entitlements. Apple does not restore consumables in the same way it restores eligible non-consumable purchases, but Uyqu's stable private account preserves a verified server credit balance across ordinary reinstall and devices using the same App Store account. If a verified balance is missing, contact support with your Support ID, pack size, approximate purchase date, and only the Apple transaction details you are comfortable sharing.

You retain rights you already hold in text or settings you submit. You give Uyqu and its processors a limited, worldwide license to host, transmit, reproduce, transform, and process that input only as needed to operate, secure, troubleshoot, and deliver the requested service.

You must not use Uyqu to:

• break the law, violate another person's privacy, publicity, intellectual-property, contractual, or other rights;
• request or distribute unlawful, exploitative, hateful, abusive, deceptive, or harmful material;
• impersonate a person, misrepresent AI output as an authentic recording, or facilitate fraud;
• probe, reverse engineer, disrupt, overload, scrape, automate abuse of, or bypass the app, authentication, App Check, purchase validation, delivery controls, safety measures, or generation limits;
• resell access, credits, or the service without written permission.

AI output is probabilistic. Similar or identical material may be generated for others, and a result may be unexpected, inaccurate, unsuitable, or potentially subject to third-party rights. Uyqu does not promise that output is unique, copyrightable, non-infringing, or fit for commercial use.

As between you and Uyqu, and to the extent permitted by law and provider terms, Uyqu grants you any rights it may hold in a completed AI soundscape delivered specifically to you. You may play, reproduce, export, share, and use that delivered output for lawful personal or commercial purposes. You are responsible for reviewing output and obtaining any rights, clearances, or professional advice needed for a particular use. You may not present an AI-generated soundscape as evidence of a real event or as the work of a specific artist.

Export is available only for completed AI creations with an audio file available on your device. After a creation is delivered, export does not require a continuing Pro subscription; however, Uyqu cannot recover a file you delete or lose unless your optional private iCloud copy remains available. This permission and export feature do not apply to curated or bundled audio, individual source stems, previews, blends, frequency tracks, the app, branding, or other Uyqu content. Those materials remain licensed for in-app use only and may not be extracted, copied, exported, redistributed, or resold.

Uyqu, its interface, software, designs, branding, bundled content, and documentation are owned by Mustafa Batın Efe or the relevant licensors and are protected by law. Subject to these Terms and Apple's Standard EULA, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices you own or control as permitted by Apple's usage rules.

Feedback is voluntary. You allow us to use feedback without restriction or compensation, but it does not give us ownership of your private content.

The Privacy Policy explains local sleep data, AI processing, temporary delivery, purchases, and optional private iCloud storage. Uyqu relies on services provided by Apple, Google Firebase and Vertex AI, RevenueCat, and Cloudflare. Their availability and processing are also subject to their applicable terms and policies. We are not responsible for a third-party service beyond what applicable law requires.

You may stop using Uyqu at any time and can cancel Pro through Apple. We may restrict online generation or suspend an identity when reasonably necessary to investigate fraud, protect the service, comply with law, or address a material breach of these Terms. Where appropriate, we will provide notice and a way to contact support.

Pro access ends when the verified paid subscription expires. Deleting an identity can permanently remove access to its consumable-credit balance. Sections that by their nature should survive—such as payment records, ownership, disclaimers, liability, and dispute terms—remain in effect after termination.

To the maximum extent permitted by law, Uyqu and its output are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, quiet enjoyment, and uninterrupted or error-free operation. We do not warrant a particular sleep, wellness, creative, generation, download, or storage outcome.

These exclusions do not apply where a warranty cannot legally be excluded.

To the maximum extent permitted by law, Uyqu and Mustafa Batın Efe will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or business arising from Uyqu. Where liability cannot be excluded, total liability will not exceed the greater of the amount you paid for Uyqu during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any consumer right or other liability that cannot lawfully be excluded or limited.

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Before starting formal proceedings, please contact us and allow a reasonable opportunity to resolve the issue. Courts and competent authorities in Istanbul, Türkiye will have jurisdiction, except that you may bring a claim in another forum when mandatory consumer law gives you that right.

We may update these Terms for new features, provider requirements, security, legal compliance, or other legitimate reasons. The new effective date will be posted here. If a change is material, we will provide notice or request renewed acceptance where required. Changes apply prospectively and do not remove mandatory rights or retroactively expire purchased credits.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a lawful reorganization or transfer of Uyqu. These Terms, the Privacy Policy, Apple's Standard EULA, and the purchase terms shown by Apple form the agreement governing Uyqu.
