Terms & Conditions

Welcome to PlaceX. These Terms and Conditions ("Terms") govern your use of the PlaceX mobile application ("Service") provided by Mustafa Batin Efe ("we," "us," or "our").

1. Acceptance of Terms

By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. User Accounts

To access most features, you must create an account using Sign in with Apple. You may also browse certain features as a Guest. You agree to provide accurate information and are responsible for safeguarding your account credentials.

2.1 Account Responsibility

Your subscription and credits are linked to your Apple ID and device credentials. Credits are non-transferable between accounts.

2.2 Device Authentication

We use Apple's App Attest framework to verify genuine Apple devices. Attempting to circumvent device authentication may result in account suspension or termination.

2.3 Age Requirement

You must be at least 16 years old to create an account and use the Service.

3. In-App Purchases, Subscriptions, and Credits

3.1 General

The Service offers virtual credits ("Credits") and subscriptions. All payments are processed through the Apple App Store.

3.2 Subscriptions

Subscriptions are billed on a recurring basis (weekly, monthly, or yearly) and auto-renew unless cancelled at least 24 hours before the billing period ends. Manage subscriptions via Apple ID account settings.

3.3 Credits

Permanent Credits: Purchased as one-time Credit Packs. Never expire.

Subscription Credits: Included with active subscriptions. Expire upon renewal and are replaced with a fresh allotment.

Credit costs per generation: Standard (10 credits), HD (20 credits, Premium only), Ultra (50 credits, Premium only).

3.4 Refunds

All refund requests are handled by Apple through App Store purchase history. One-time Credit Pack payments are final and non-refundable.

4. User Content and Conduct

4.1 Ownership

You retain full ownership of the original photos you upload.

4.2 Your Representations

BY UPLOADING ANY PHOTO, YOU REPRESENT THAT: you are the sole person depicted or have obtained explicit consent; you own the copyright or have necessary licenses; the use does not violate any laws; you are not uploading photos of minors unless you are their legal guardian; and you will not use generated images for illegal or harmful purposes.

4.3 License to Us

By uploading content, you grant us a limited, non-exclusive license to use it solely for operating and providing the Service to you.

4.4 Third-Party Processing

Your content is sent to third-party AI service providers (FAL.ai) for processing. Images are processed temporarily and deleted automatically (typically within 1 hour).

4.5 Acceptable Use

You agree not to upload content that depicts any person without consent, is illegal or hateful, infringes on third-party rights, depicts minors inappropriately, or could be used for identity fraud.

5. Moderation and Content Safety

We reserve the right to monitor content and remove material that violates these Terms. We may use automated safety filters and suspend or terminate violating accounts.

6. Failed Generations and Credit Refunds

Refundable Failures: Server-side errors automatically refund credits as permanent credits.

Non-Refundable Failures: Content safety violations result in no refund. Contact help@mbefe.com within 24 hours if you believe content was incorrectly flagged.

7. Anti-Fraud and Abuse Prevention

We employ device attestation and security measures to prevent fraud. Abuse may result in immediate account termination without refund.

8. Disclaimers and Limitation of Liability

THE SERVICE AND ALL AI-GENERATED IMAGES ARE PROVIDED "AS-IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee generated images will be perfect, error-free, or suitable for any purpose. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim, or $100, whichever is less.

9. Indemnification

You agree to indemnify and hold harmless PlaceX from any claims arising from your use of the Service, your content, or your breach of these Terms.

10. DMCA and Takedown Requests

Contact help@mbefe.com with details about content that infringes your rights. We will investigate and take appropriate action.

11. Privacy Policy

Your use of the Service is also governed by our Privacy Policy.

12. Termination

We may suspend or terminate your account at any time for breach of Terms. Upon termination, unused credits are forfeited.

13. Dispute Resolution

Before filing any formal claim, contact help@mbefe.com to attempt informal resolution for at least 30 days. You waive the right to participate in class action lawsuits.

14. Governing Law

These Terms are governed by the laws of Republic of Türkiye. Legal proceedings shall be brought in Istanbul, Türkiye.

15. Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement regarding your use of the Service.
