1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App.

You must be at least 12 years old to use Cosmetry.

2. Account & Authentication

Cosmetry uses Apple's App Attest framework for device-level authentication.

• One account is created per device
• No email, password, or Apple ID credentials are collected by us
• Your account persists across app reinstalls on the same device
• Deleting your account permanently removes all associated data

3. Credits & Subscriptions

Cosmetry uses a credit-based system for AI-powered features.

Important Credit & Subscription Terms

• Credits are non-refundable except as required by law or Apple's refund policies
• Subscription credits reset on each renewal period — unused credits do not carry over
• Credit pack credits do not expire as long as your account is active
• Deleting your account forfeits all remaining credits. Anonymized purchase records are retained to prevent fraud and abuse
• Credits cannot be transferred, gifted, or carried over between accounts
• Subscriptions are managed through Apple — cancel anytime in iOS Settings
• Refunds are handled exclusively through Apple's refund policies

4. AI Features & Disclaimer

• AI Chat and AI Photo Scan are powered by Google Gemini API
• AI responses may be inaccurate, incomplete, or misleading — always verify independently
• AI-extracted product information should be reviewed and corrected by you before saving
• The App does not diagnose skin conditions, prescribe treatments, or replace professional medical advice
• For severe skin reactions, seek immediate medical attention

5. User Responsibilities

• Provide accurate product and ingredient information to the best of your knowledge
• Do not rely solely on the App for medical or health-related decisions
• Consult a professional for severe or persistent skin reactions
• Use the App in compliance with all applicable laws
• Do not attempt to manipulate the credit system or reverse-engineer the App

6. Ingredient Database

Cosmetry includes a reference database of skincare ingredients with INCI names, safety ratings, and functional descriptions. This database is provided for informational purposes only. Ingredient data may be incomplete, safety ratings are general references, and allergen flagging is based on your personal avoid list.

7. Intellectual Property

• The App, its design, code, and content are owned by Mustafa Batin Efe
• You retain full ownership of your personal data
• The "Cosmetry" and "Cosmai" names and logos are trademarks of the developer
• You may not copy, modify, distribute, or create derivative works from the App

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We are not liable for skincare decisions made based on App information, adverse skin reactions, inaccurate AI-generated data, or data loss. In no event shall our total liability exceed the greater of (a) the amount you paid us in the preceding 12 months, or (b) $100 USD.

9. Indemnification

You agree to indemnify and hold harmless Mustafa Batin Efe from claims arising from your violation of these Terms, misuse of the App, skincare decisions based on App data, or failure to seek professional advice when appropriate.

10. Force Majeure

We shall not be liable for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, internet outages, third-party service failures, government actions, or cyberattacks.

11. Account Termination

• Delete your account at any time from Profile > Delete Account
• Account deletion is permanent and irreversible
• Cancel active subscriptions in iOS Settings before deleting your account
• We reserve the right to terminate accounts that violate these Terms

12. Data Processing & GDPR

For EU/EEA users, we process personal data in accordance with the GDPR. We act as the data controller. You have the right to access, rectify, erase, restrict processing, and port your personal data. Contact help@mbefe.com to exercise your rights. See our Privacy Policy for full details.

13. Modifications to Terms

We may update these Terms from time to time. The "Last Updated" date at the top will reflect changes. Your continued use of the App after changes constitutes acceptance.

14. Dispute Resolution

Before initiating any formal proceedings, you agree to first contact us at help@mbefe.com to attempt to resolve any dispute informally for a period of 30 days. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts located in Istanbul, Turkey.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Istanbul, Turkey.
